How My Lasting Power of Attorney Service Works:
Setting up your Lasting Powers of Attorney doesn’t have to be difficult or confusing. Here’s how I guide you through the process from start to finish—professionally, personally, and without any pressure.
Step 1: Initial Contact
Get in touch however suits you best—by phone, email, or using the form on the Get Started page. I’ll ask a few simple questions to understand your situation and explain how I can help. There’s no obligation and no hard sell.
Step 2: When you decide to go ahead
Initially, I will send you a simple form to get the basic details – only you can guarantee they are correct!
I am required to get proof of identity – ideally a copy of driving licence and/or passport. In place of one photo ID card, a utility bill or Council Tax showing both names (or posted bank statements). This bit is starting to get more difficult, but we will sort it!
Step 3: Return the form
By post or email, plus the 50% initial fee (cheque or bank transfer as you wish)
Step 4: A Proper Discussion
We’ll arrange a time to talk properly—either in person (if you’re local to Eastbourne, Hailsham, Seaford or Polegate), or by phone or video call if you’re elsewhere in England or Wales. This part is usually only 10 to 15 minutes before we get onto the next stage in the same call.
This is where I can answer your questions such as:
- What LPAs are and why you need both of them
- The difference between Property & Financial and Health & Welfare LPAs
- Who you can appoint and what their responsibilities are
- What’s involved and how long it takes
You’ll have the chance to ask anything you like.

Step 5 Taking Instructions
Once you’re ready to go ahead, I’ll take full instructions, making sure we get the details exactly right. I’ll guide you through:
- Choosing the right attorneys
- Replacement attorneys (if needed)
- How you want decisions to be made
- Any preferences or restrictions you’d like to include
This is where I really add value to your Lasting Powers of Attorney.
Step 6: Drafting & Signing
I’ll prepare the documents professionally and check everything for accuracy (full names, dates of birth and correct addresses I can’t fully check, so it is crucial you get these right).
Step 7: Draft LPAs for you to approve
You get to double-check that I have everything as you wish – or change it if you decide to. No charge for one set of changes! Once approved, the balance of my fee is payable, then on to Step 8.
Step 8. Final Documents
- I prepare the final documents for signature – if you are not local, I will post them to you with clear instructions that guide everyone through the signing process (including witnesses and certificate provider).
- I offer clear instructions if some signatures are being done remotely
- If you are local and I’m the certificate provider, I’ll complete that role as part of the process
- The option of any queries and the documents coming to me first, so I can talk you through them.
- Be aware that any issues will result in an additional fee payable to them of £41 per LPA as long as they are resolved quickly. I will send you a list of the most common issues.
Step 9: Registration
Once the forms are signed and checked, I submit them to the Office of the Public Guardian for registration. At this point, you will be asked to pay the Registration fee to the Office of the Public Guardian (usually £82 per LPA at present). I do recommend that I check them before they are sent off, as I can usually spot things they may query. You can, of course, send them in directly to the Office of the Public Guardian should you wish it.
This stage sadly takes around 12 weeks, depending on OPG workloads, but their communications are poor, and they typically do nothing at all for around six weeks, four of which are required by Law. I also offer support if the OPG raise any queries or need clarification.
Step 10: Secure Delivery & Ongoing Support
Once registered, you’ll receive your official LPA documents securely. I can also:
- Keep digital copies for you.
- Offer copies for your attorneys.
- Advise you on certifying copies of your LPAs at no cost.
- Help you to store the originals safely.
